Our Terms of Service outline the rules, rights, and responsibilities of using Emberal. We keep it fair, transparent, and straightforward.

These Terms of Service ("Terms") govern your access to and use of the Emberal mobile application and related services (collectively, the "App") provided by Emberal ("Emberal," "we," "us," or "our").
By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
Emberal is intended for users at least 12 years old due to wellness, habit-tracking, emotional self-reflection, burnout-awareness, and AI coaching-style features. By creating an account, you represent that you meet this age requirement in your jurisdiction.
You may create an account using Apple Sign In, Google Sign In, or email. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at **support@emberal.app** if you suspect unauthorized access.
Emberal is a non-medical, wellness, self-help, and personal habit-tracking application designed to support users in building consistency, tracking daily rituals, reflecting on personal patterns, and understanding their momentum. The App provides ritual tracking, daily check-ins, Life Score, streak tracking, momentum, discipline, recovery, and burnout-risk indicators, journaling, progress insights, an AI coaching-style experience, spirit evolution, auras, reminders, and optional sharing or community-style features where available.
The Emberal App is **not** a healthcare service, medical device, therapy platform, counseling service, diagnosis tool, emergency service, or treatment program. Emberal does **not** provide medical advice, diagnosis, treatment, therapy, counseling, or clinical recommendations. No doctor-patient, therapist-client, coach-client, or healthcare provider relationship is created through the App.
Life Score, burnout-risk indicators, recovery scores, momentum scores, discipline scores, streaks, auras, levels, insights, reminders, and milestones presented in the App are informational and motivational features. They are based on user-entered activity, app interactions, and general behavioral patterns. They may not reflect any medically validated condition, risk, diagnosis, or individual outcome.
The AI coaching-style experience provides informational support and self-reflection prompts based on the information you provide and your App activity. It is **not** a therapist, counselor, doctor, coach, or medical professional. Its responses do not constitute medical, psychological, therapeutic, financial, legal, or professional advice.
If you are experiencing a medical or mental health emergency, contact your local emergency services immediately.
Emberal offers paid subscription plans. By subscribing, you agree to pay the applicable fees displayed at the time of purchase.
**Billing:** Subscriptions are billed through the Apple App Store or Google Play Store. Payment is charged to your App Store or Play Store account at confirmation.
**Auto-renewal:** Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
**Cancellation:** You may cancel at any time through your App Store or Play Store subscription settings. Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time within a billing period.
**Price changes:** We may change subscription pricing. Price changes take effect at the start of the next subscription period after notice. Continued use after a price change constitutes acceptance.
**Free access:** If a free tier is offered, it may be modified, limited, or removed at any time without prior notice.
Refunds are handled by Apple or Google according to their respective refund policies. Emberal does not process refunds directly. To request a refund, contact Apple App Store Support or Google Play Support.
You agree not to:
- Use the App for any unlawful purpose
- Post content that is abusive, harassing, threatening, hateful, discriminatory, sexually explicit, exploitative, or otherwise harmful in any community, sharing, or social areas
- Impersonate another person or entity
- Attempt to access other users' accounts or data
- Interfere with or disrupt the App's functionality, servers, security systems, or infrastructure
- Upload malicious code, viruses, or harmful content
- Use automated systems, bots, scrapers, or similar tools to access the App
- Resell, redistribute, sublicense, reverse engineer, or commercially exploit the App or its content
- Use the App to provide medical, psychological, therapeutic, legal, financial, or other professional advice to others
We reserve the right to suspend or terminate accounts that violate these Terms.
Community features, if available, including posts, comments, leaderboards, friend features, shared progress, or other social areas, are subject to the following:
- Be respectful and supportive of other users
- Do not share personally identifiable information about yourself or others
- Do not post medical, psychological, therapeutic, legal, financial, or professional advice
- Do not encourage self-harm, dangerous behavior, disordered behavior, harassment, or unhealthy competition
- Do not post spam, advertisements, promotional content, or misleading claims
We may remove content or suspend accounts that violate these guidelines at our discretion without prior notice.
The App, including its design, code, content, branding, logos, mascot characters, spirit evolution system, Life Score system, score labels, ritual categories, insights, visual assets, and AI-generated or AI-assisted responses provided through the App, is owned by Emberal or its licensors and protected by intellectual property laws. You may not copy, modify, distribute, sell, sublicense, reverse engineer, or create derivative works based on the App without our written permission.
You retain ownership of content you create within the App, such as journal entries, notes, custom rituals, check-ins, shared posts, comments, or other user-generated content. By posting content in community or shared areas, you grant Emberal a non-exclusive, worldwide, royalty-free license to display, host, store, reproduce, and distribute that content within the App for the purpose of operating and improving those features.
The AI coaching-style experience may be powered by third-party artificial intelligence providers. Responses are generated algorithmically and may occasionally be inaccurate, incomplete, inappropriate, outdated, or not suitable for your circumstances. Emberal does not guarantee the accuracy, reliability, safety, usefulness, or suitability of AI-generated responses.
Do not rely on the AI coaching-style experience for medical, psychological, therapeutic, legal, financial, emergency, or professional advice. Always consult qualified professionals for such matters.
Life Score, burnout-risk indicators, recovery scores, momentum scores, discipline scores, streaks, health-related logs, sleep-related logs, workout-related logs, mood entries, milestones, and other wellness indicators presented in the App are based on information you provide, app activity, general behavioral concepts, and automated calculations.
These features represent informational and motivational signals only. They are not medical measurements, clinical evaluations, diagnostic tools, treatment recommendations, or guarantees of health, wellbeing, performance, productivity, recovery, or burnout prevention.
Individual results may vary significantly based on factors including personal circumstances, physical health, mental health, sleep, stress, lifestyle, environment, work demands, support systems, and other factors outside the App.
Emberal makes no guarantee that you will achieve any specific personal, health, productivity, recovery, behavioral, emotional, or wellness outcome.
To the maximum extent permitted by applicable law, Emberal shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, lost opportunities, emotional distress, personal injury, or decisions made based on App outputs, arising from your use of or inability to use the App.
Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid to Emberal in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.
The App is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the App will be uninterrupted, error-free, secure, accurate, reliable, suitable for your needs, or free of viruses or other harmful components.
Indemnification
You agree to indemnify and hold harmless Emberal, its officers, directors, employees, contractors, service providers, and agents from any claims, damages, losses, liabilities, and expenses, including legal fees, arising from your use of the App, violation of these Terms, violation of applicable law, user-generated content you submit or share, or infringement of any third party's rights.
Termination
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately.
You may terminate your account at any time by deleting it through Settings -> Delete Account or by contacting **support@emberal.app**.
Provisions that by their nature should survive termination, including Limitation of Liability, Disclaimer of Warranties, Indemnification, Intellectual Property, Privacy, Governing Law, Severability, and Entire Agreement, will survive.
Privacy
Your use of the App is also governed by our Privacy Policy, available at **emberal.app/privacy**. By using the App, you consent to the collection and use of information as described in the Privacy Policy.
Change To Terms
We may modify these Terms at any time. Material changes will be communicated through the App, by email, or by posting updated Terms. Continued use of the App after changes constitutes acceptance of the revised Terms.
If you do not agree to the revised Terms, you should stop using the App and delete your account.
Governing Law
These Terms are governed by the laws of the Hellenic Republic (Greece), without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be resolved in the courts of Athens, Greece.
For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and Emberal regarding your use of the App and supersede any prior agreements.
